Terms of Service

These terms are an agreement between you and Matthew Rostkowski, a sole proprietor operating as Join Queue. By using the Join Queue app you agree to them. If you do not agree, do not use the app.

What Join Queue is

Join Queue is a request and ordering tool. It lets guests at a gathering ask for songs, pay to put a song into the room's queue, and vote on the order. It does not stream, perform, broadcast or license music. All music plays from the host's own music service subscription, on the host's own device, through the host's own speakers.

What a payment buys

Paying for a song request buys that song a place in the queue. It does not buy the song, a copy of the song, a licence to it, a position in the order, a guaranteed play, or a guaranteed time.

The order is decided by votes and nothing else. Every request enters the queue on the same footing and moves only as people vote on it. The amount you pay reflects how busy the room is at the moment you ask; it is calculated by us, is the same for anyone requesting at that moment, and has no effect on where your song sits. There is no way to pay for a better position, and the app does not offer one.

You are not charged for a request that does not play. If a room ends before your request comes up, the authorisation is released and you are not charged. If a payment is captured for a song that did not play, contact us and we will refund it.

A song that has begun playing has played, and its charge stands, including where the host skips it partway through.

Votes

Every user gets one free upvote or downvote on any song in the queue. Votes bought in the Store increase your weight on a single song, up to a maximum of three, and only upward: a downvote is always one vote, always free, and can never be stacked or bought. Nobody can pay to push someone else's song down.

Only the host can skip the song that is playing. That is not something the app sells, and no payment of any kind affects it.

In-app purchases

Items bought in the Store — vote packs, request packs and Queue+ — are Apple in-app purchases. Apple takes the payment, applies its own terms, and handles refunds for them; request a Store refund from Apple at reportaproblem.apple.com. Credits and votes bought this way have no cash value, are not transferable, and are forfeited if you delete your account.

Song requests inside a room are not in-app purchases. They are taken by Stripe, and the refund terms below apply to them.

Refunds

Song requests that do not play are not charged. If you believe you were charged in error, email [email protected] within 30 days with the room and the approximate time and we will look into it. Refunds are issued to the original payment method.

A request that played is not refundable simply because you changed your mind, or because you disliked how the room voted.

Host responsibilities

If you host a room, you confirm that:

• You hold a current subscription to the music service you are using, and you are using it in accordance with that service's own terms, which are personal and non-commercial.
• You have the right to play music in the place where you are playing it. Playing music in a business, a venue or any public setting generally requires a licence from a performing rights organisation, and getting that licence is your responsibility, not ours.
• You are responsible for the room you open: what plays in it, who is in it, and how the money is handled between you and your guests.

Acceptable use

Do not use Join Queue to harass anyone, to break the law, to interfere with the service or another person's room, to attempt to gain access to accounts or data that are not yours, or to circumvent the payment system. We may suspend or remove an account that does any of these.

Your account

You are responsible for what happens under your account and for keeping your sign-in details to yourself. Tell us promptly if you think someone else has access to it. You can delete your account at any time from Profile → Privacy → Delete Account.

Availability

Join Queue is provided as it is. We do not promise it will be uninterrupted or error free, and we may change or discontinue features. The app depends on services we do not control, including Apple Music, Stripe, and the network in the room you are standing in.

Limitation of liability

To the fullest extent the law allows, Join Queue is not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data, arising out of your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid through the app in the twelve months before the claim, or twenty-five US dollars.

Nothing in these terms limits liability that cannot be limited under the law that applies to you, and some jurisdictions do not allow the exclusions above, in which case they do not apply to you.

Governing law

These terms are governed by the laws of the District of Columbia, United States, without regard to its conflict of laws rules. Any dispute will be brought in the courts located in the District of Columbia, and you and we each consent to that jurisdiction.

Changes to these terms

If we change these terms we will update the date at the top, and for material changes we will tell you in the app before the change takes effect. Continuing to use the app after a change means you accept the new terms.
